مرحبًا بك في تطبيق رسائل (Rasael)، المنتج الرقمي التابع لشركة مسافة لتطوير حلول التقنية، المرخّصة رسميًا من قِبَل مشغّلَي الاتصالات ليبيانا ومدار.

يُتاح التطبيق عبر Google Play وApple App Store، إضافةً إلى الموقع الرسمي rasael.ly.

باستخدامك هذا التطبيق أو تثبيته، فإنك تُقرّ بقراءة هذه الشروط والموافقة الكاملة عليها. إن كنت لا توافق على أيٍّ من البنود، يُرجى التوقف عن الاستخدام فورًا.

أهلية الاستخدام

👤

يجب أن يكون المستخدم بالغًا من العمر 18 عامًا على الأقل.
يُسمح للأفراد بين 13 و17 عامًا باستخدام التطبيق بموافقة ولي الأمر الموثّقة.
يجب أن يكون المستخدم حاملًا لرقم هاتف ليبي مسجَّل لدى ليبيانا أو مدار.
يُحظر الاستخدام على من صدر بحقه قرار حظر سابق من الشركة.

التسجيل والحسابات

3.1 إنشاء الحساب

يتطلب استخدام التطبيق إنشاء حساب شخصي بمعلومات دقيقة: الاسم الكامل، رقم الهاتف، والبريد الإلكتروني (اختياري).

3.2 التحقق من الهوية

يُستخدم رقم هاتفك المسجَّل لدى ليبيانا أو مدار كمعرّف أساسي. ستصلك رسالة OTP لإتمام التحقق.

3.3 أمان الحساب

أنت مسؤول مسؤولية كاملة عن الحفاظ على سرية بيانات الدخول. أي نشاط يصدر من حسابك يُعدّ منسوبًا إليك.

3.4 حساب واحد لكل مستخدم

لا يُسمح بإنشاء أكثر من حساب واحد للشخص ذاته. يحق للشركة إلغاء الحسابات المكررة فور اكتشافها.

الاستخدام المقبول

إرسال رسائل مشروعة لأغراض شخصية أو تجارية قانونية.
الالتزام بالقوانين الليبية واللوائح التنظيمية للاتصالات.
احترام خصوصية الآخرين وحقوقهم الأساسية.
الإبلاغ الفوري عن أي محتوى مسيء أو مخالف لهذه السياسة.
استخدام التطبيق بشكل شخصي ما لم يُتفق على خلاف ذلك كتابةً.

الاستخدام المحظور

🚫

إرسال رسائل ترويجية غير مرغوب فيها أو جماعية دون إذن (Spam).
نشر محتوى يتضمن تحرشًا أو تهديدًا أو تنمرًا أو ترهيبًا.
نشر محتوى مخالف للآداب العامة أو يتعارض مع المبادئ الإسلامية.
الاحتيال أو انتحال هوية أشخاص أو جهات أخرى.
محاولة اختراق أنظمة الشركة أو الوصول غير المصرح به لبيانات المستخدمين.
استخدام برامج آلية (Bots) أو أدوات حوسبة للتلاعب في التطبيق.
إعادة بيع الخدمة أو منح ترخيصها للغير دون إذن خطي مسبق.
توزيع محتوى ينتهك حقوق الملكية الفكرية أو التجارية.
استخدام التطبيق لأغراض تحريضية أو ما يُهدد الوحدة الوطنية أو الأمن العام.

الرسائل والمحتوى

6.1 ملكية المحتوى

يظل المستخدم المالك الحصري لمحتواه، غير أنه يمنح الشركة ترخيصًا محدودًا وغير حصري لمعالجة الرسائل وتوصيلها فنيًا.

6.2 عدم المسؤولية عن المحتوى

تعمل الشركة بوصفها ناقلًا تقنيًا فحسب، ولا تتحمل أي مسؤولية قانونية أو أخلاقية عن مضمون الرسائل المتبادَلة بين المستخدمين.

6.3 الاحتفاظ بالبيانات

قد تُحتفظ سجلات الاتصالات وفق المدد المحددة من الجهات التنظيمية المختصة في ليبيا.

6.4 تصفية المحتوى

تحتفظ الشركة بحق تفعيل أدوات تصفية آلية لرصد المحتوى المخالف للسياسة.

الخصوصية وحماية البيانات

7.1 البيانات المُجمَّعة

رقم الهاتف، اسم المستخدم، بيانات الجهاز، وسجلات الاستخدام.

7.2 الغرض من الجمع

تشغيل الخدمة، تحسين الأداء، منع الاحتيال، والامتثال للمتطلبات التنظيمية.

7.3 مشاركة البيانات

لا تُباع البيانات الشخصية لأطراف ثالثة. يجوز مشاركتها مع المشغّلين للتحقق التشغيلي أو مع الجهات الحكومية بموجب طلب قانوني رسمي.

7.4 الأمان

تعتمد الشركة معايير تشفير قياسية (TLS/AES) لحماية بيانات المستخدمين أثناء النقل والتخزين.

الملكية الفكرية

جميع العلامات التجارية والشعارات وواجهات المستخدم والمحتوى الرقمي الخاص بتطبيق رسائل هي ملك حصري لشركة مسافة لتطوير حلول التقنية، ومحمية وفق القوانين الليبية والاتفاقيات الدولية المتعلقة بحقوق الملكية الفكرية.

لا يُمنح المستخدم أي حق في نسخ أو تعديل أو هندسة عكسية أو إعادة توزيع أي جزء من التطبيق دون إذن خطي صريح مسبق من الشركة.

حدود المسؤولية

10.1 الخدمة "كما هي"

تُقدَّم الخدمة دون ضمانات صريحة أو ضمنية بالجاهزية المتواصلة أو الخلو التام من الأخطاء.

10.2 إخلاء المسؤولية

انقطاع الخدمة الناجم عن قوة قاهرة أو عطل في شبكات المشغّلين.
أي خسارة تجارية أو ضرر غير مباشر ناتج عن الاستخدام أو التعذّر عنه.
محتوى الرسائل المتبادَلة بين المستخدمين.

10.3 الحد الأقصى للمسؤولية

لا تتجاوز المسؤولية المالية للشركة مجموع الرسوم التي دفعها المستخدم خلال الثلاثة أشهر السابقة لحادثة الضرر.

التعليق والإنهاء

تحتفظ الشركة بالحق في اتخاذ الإجراءات التالية دون إشعار مسبق عند الاشتباه أو إثبات المخالفة:

التعليق المؤقت — تجميد الحساب ريثما يُحسم التحقيق.
الإنهاء الدائم — حذف الحساب نهائيًا عند ثبوت المخالفة الجسيمة.
الإحالة للجهات المختصة — الإبلاغ الرسمي في حالات الجرائم الإلكترونية.

يحق للمستخدم حذف حسابه ذاتيًا في أي وقت من خلال الإعدادات ← حذف الحساب.

التعديلات على السياسة

تحتفظ الشركة بحق مراجعة وتعديل هذه السياسة دوريًا. في حال التعديلات الجوهرية، يُبلَّغ المستخدمون عبر:

إشعار بارز داخل التطبيق قبل 7 أيام من السريان.
رسالة نصية على رقم الهاتف المسجَّل.

⚠️

استمرارك في استخدام التطبيق بعد سريان أي تعديل يُعدّ موافقةً ضمنيةً على التعديلات الجديدة.

القانون الواجب التطبيق وتسوية النزاعات

تخضع هذه الاتفاقية وتُفسَّر وفق القوانين الليبية النافذة، بما فيها قانون الاتصالات ولوائح هيئة الاتصالات والمعلوماتية.

في حال نشوء أي نزاع، يُلتزم بمحاولة التسوية الودّية خلال مدة لا تتجاوز 30 يومًا من تاريخ الإخطار الرسمي. وإن تعذّر الحل، يُحال النزاع إلى المحاكم الليبية المختصة.

Eligibility

You must be at least 18 years of age to use the application.
Users aged 13–17 may use the application only with documented parental or guardian consent.
You must hold a Libyan phone number registered on the Libyana or Madar networks.
Individuals previously banned by the Company are strictly prohibited from re-registering.

Registration & Accounts

3.1 Account Creation

Using the application requires a personal account with accurate information: full name, phone number, and optionally an email address.

3.2 Identity Verification

Your Libyana or Madar registered phone number serves as your primary identifier. An OTP will be sent to complete verification.

3.3 Account Security

You are fully responsible for maintaining the confidentiality of your credentials. Any activity conducted from your account is attributed solely to you.

3.4 One Account Per Person

Creating multiple accounts is strictly prohibited. The Company reserves the right to terminate duplicate accounts immediately upon discovery.

Acceptable Use

Send lawful messages for legitimate personal or commercial purposes.
Comply with all applicable Libyan laws and telecommunications regulations.
Respect the privacy and fundamental rights of other users.
Promptly report any abusive or policy-violating content.
Use the application on a personal basis unless otherwise agreed in writing.

Prohibited Use

Sending unsolicited bulk promotional messages (Spam).
Publishing content involving harassment, threats, bullying, or intimidation.
Sharing content contrary to public morality or Islamic principles.
Fraud, impersonation, or misrepresentation of identity.
Attempting to breach Company systems or gain unauthorized access to user data.
Using automated bots or scripting tools to interact with the application.
Reselling or sublicensing the Service without prior written consent.
Distributing content that infringes intellectual property or trade rights.
Using the application for incitement or activities that threaten national security.

Messages & Content

6.1 Content Ownership

Users retain exclusive ownership of the content they create but grant the Company a limited, non-exclusive license to process and technically deliver messages through the network infrastructure.

6.2 No Liability for Content

The Company operates solely as a technical carrier and bears no legal or moral responsibility for the content of messages exchanged between Users.

6.3 Data Retention

Communication logs may be retained for periods determined by relevant Libyan regulatory authorities.

6.4 Content Filtering

The Company reserves the right to deploy automated filtering tools to detect policy-violating content without compromising lawful personal communications.

Privacy & Data Protection

7.1 Data Collected

Phone number, username, device information, and usage logs.

7.2 Purpose

Operating the service, improving performance, fraud prevention, and regulatory compliance.

7.3 Data Sharing

Personal data is never sold to third parties. It may be shared with Operators for operational verification or with government authorities pursuant to a lawful legal request.

7.4 Security

The Company applies industry-standard encryption (TLS/AES) to protect user data in transit and at rest.

Intellectual Property

All trademarks, logos, user interfaces, graphics, and digital content associated with Rasael are the exclusive property of Masafa Technology Solutions Development, protected under applicable Libyan law and international intellectual property conventions.

Users are not granted any right to copy, modify, reverse-engineer, or redistribute any part of the application without prior explicit written permission from the Company.

Limitation of Liability

10.1 "As Is" Service

The Service is provided without express or implied warranties of uninterrupted availability or freedom from errors.

10.2 Exclusions

Service interruptions caused by force majeure or Operator network failures.
Business losses or indirect damages resulting from use of, or inability to use, the application.
Content of messages exchanged between Users.

10.3 Maximum Liability Cap

The Company's total financial liability shall not exceed the fees paid by the User during the three months preceding the damage-causing incident.

Suspension & Termination

The Company reserves the absolute right to take the following actions without prior notice upon suspicion or confirmation of a violation:

Temporary Suspension — Account frozen pending investigation.
Permanent Termination — Account deleted upon confirmed serious violation.
Referral to Authorities — Official reporting in cases of cybercrime.

Users may self-delete their accounts at any time via Settings → Delete Account.

Amendments

📝

The Company reserves the right to periodically review and amend this Policy. Users will be notified of material changes via:

A prominent in-app notice at least 7 days before changes take effect.
An SMS to the registered phone number.

⚠️

Continued use of the application after any amendment becomes effective constitutes your implicit acceptance of the revised Terms.

Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with Libyan law, including the Telecommunications Law and regulations issued by the Telecommunications and Informatics Authority.

In the event of a dispute, the parties shall first attempt amicable resolution within 30 days of formal written notice. Failing that, the dispute shall be submitted to the competent Libyan courts for final and binding adjudication.
